Thank you for using Altitude Compass. By using Altitude Compass, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Altitude Compass.
We may revise these Terms from time to time. The most current version will always be posted on our Terms page. By continuing to use Altitude Compass after the revisions become effective, you agree to be bound by the revised Terms.
For auto-renewable subscriptions completed in our iOS applications, the following terms apply:
Altitude Compass and its licensors exclusively own Altitude Compass and all related intellectual property rights. You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights or notices incorporated in or accompanying Altitude Compass.
Altitude Compass grants you a limited, non-exclusive, non-transferable license to view, copy and display Altitude Compass solely in connection with your permitted use of Altitude Compass.
We respect copyright laws and expect you to do the same. It is our policy to terminate accounts that repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.
The intellectual property of Altitude Compass or our licensors is provided "as is" without warranty of any kind. Without limiting the foregoing, we expressly disclaim any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement, and any warranties arising from a course of dealing or usage of trade.
We make no warranty that Altitude Compass will meet your requirements or that the service will be available on an uninterrupted, secure or error-free basis.
We make no warranties as to the quality, accuracy, timeliness, truthfulness, completeness or reliability of any of our intellectual property.
These Terms constitute the complete and exclusive understanding and agreement between Altitude Compass and you with respect to Altitude Compass, and these Terms supersede and replace any and all prior oral or written understandings or agreements between Altitude Compass and you with respect to Altitude Compass, except that if you become a party to the Altitude Compass Business Agreement before or after reviewing these Terms, the terms and conditions of the Business Agreement will prevail over any conflicting terms herein. If for any reason a court of competent jurisdiction finds any provision of these Terms to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will continue in full force and effect.
These Terms may not be assigned or transferred by you, by operation of law or otherwise, without Altitude Compass’ prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be void. Altitude Compass may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
Any notices or other communications provided by Altitude Compass under these Terms, including those regarding modifications to these Terms, will be provided by: (i) Altitude Compass sending them via email; or (ii) posting them on our website. For notices given by email, the date of receipt will be deemed the date such notice was sent.
Altitude Compass's failure to enforce any right or provision of these Terms will not be deemed a waiver of such rights. Any waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Altitude Compass. Except as expressly provided in these Terms, the exercise by either party of any remedy under these Terms will be without prejudice to its other remedies under these Terms or otherwise.
